🐭 Trade Name and Restrictions in Japan

Assume that you wish to start a business in Japan. When you start your business, you will use your own trade name (e.g. New Disney land). 

In that case, you need to know about Japan’s Unfair Competition Prevention Law relating to trade name in Japan.

🐰Here, I would like to explain it in simple terms.

There is a famous theme park called Tokyo Disneyland.

Thus, if you use a trade name identical or similar to an already existing trade name for the same type of business, you may be presumed to be using the trade name for the purpose of unfair competition. In such a case, you may be subject to a claim for damages from an existing business operator.

In other words, if you start a theme park called “New Disneyland,” you may be subject to a claim for damages from “Tokyo Disneyland.

🐭Even if your business differs from that of the existing operator, if the trade name of the existing operator is well-known, you may be subject to a claim for damages from the existing operator.

Tokyo Disneyland is a very famous trade name in Japan. Therefore, even if you use the trade name “New Disneyland” in your real estate brokerage business, you may be subject to a claim for damages from Tokyo Disneyland.
