Assumed that you are living in Japan as English teacher at language school.
In this case your status of residence will be ” Engineer/Specialist in humanities/International services = Gijutsu / Jinbunchishiki kokusai gyomu”.
If you start business by yourself during your current status of residence, you need to apply for change of category of status residence into status of residence of business manager (Keiei Kanri).
If you have managed your business without alternation mentioned above, at the time you apply for extension of status of residence, there are possibilities that your application is rejected.
( If a person who has status of residence of Engineer/Specialist in humanities/International services has changed his/her workplace, he/she needs to inform immigration office within 14 days ).
In the case a person who has status of residence of Engineer/Specialist in humanities/International services and valid period of five years has changed his/her status of residence into business manager, valid period will be one year.
Extension of status of residence in Japan
In the event you have status of residence in Japan, excluding permanent residence, there is a valid period.
If you do not extend valid period of your status of residence and continued to reside in Japan, your residence, stay in Japan is illegal and you may receive deportation order.
So you can apply for extension of status of residence from two months prior to expiration date.
As far as you have made application for extension of status of residence in Japan within valid period of status of residence, even if you have not received any response from authority, your residence in Japan is still legal.
However if two months has passed from expiration date ( even if authority does not take any action ), your residence in Japan becomes illegal.
If your period of status of residence in Japan has expired while you are in the process of renewing your status of residence
Let’s assume that you have a status of residence in Japan. (Valid until May 31, 2023)
And you have submitted documents to the Immigration Bureau to renew your status of residence.
(Submitted on May 16, 2023)
Your period of stay has expired while you were waiting for the result of the permission to renew your status of residence. In other words, May 31, 2023 has passed.
Here is an explanation of your status in Japan in this case.
You are not an illegal resident even though May 31, 2023 has passed.
This is because you are in the process of renewing your status of residence, so a special exception applies to you.
In your case, you may use your current status of residence until the earlier of the following dates.
In other words, if you have a status of residence as a company employee, you can continue to work as a company employee.
(1) Until the result of the denial of the renewal procedure of your status of residence.
(2) Until the date two months after May 31, 2023.
(i.e., until July 31, 2023)
Example 1
You received a decision of non-renewal of your status of residence on June 30, 2023. In this case, two months have not yet elapsed since May 31, 2023, but from June 30, 2023 you will no longer be able to use your current status of residence.
Example 2
You failed to receive the result on the renewal of your status of residence by July 31, 2023. The immigration officials must have been busy.
In this case, you will not be able to use your current status of residence after July 31, 2023.
🌸 If your application for renewal of your status of residence is not approved
You apply for a “Designated Activities” visa to prepare for your departure from Japan.
And you will be granted “31 days” or “30 days” period of stay by this “Designated Activities” visa application.
You must leave Japan within these periods.
If you are granted 31 days as a status of residence “Designated Activities = Activities to prepare to leave Japan,” you can receive a “special period of stay” one more time if you reapply during this period.
In other words, you can extend your period of stay for up to two months.
On the other hand, if the period of “specified activities = activities to prepare for leaving Japan” you were given was 30 days, you cannot extend this period. Therefore, you must leave Japan within this 30-day period.
🌸If you do not receive the result of the examination on the renewal of your status of residence by July 31, 2023, you will become an illegal resident from August 1, 2023.
Therefore, you need to prepare to leave Japan before August 1, 2023 comes near.
To avoid this, you should apply for renewal of your status of residence three months before May 31, 2023 (March 1, 2023).
